In this case, Double Diamond, Inc. and R. Mike Ward appeal the trial courts take-nothing summary judgment on their claims for defamation and declaratory judgment. We conclude the trial court should not have granted summary judgment against appellants on their declaratory judgment claim. We reverse that portion of the judgment and remand to the trial court for further proceedings. We affirm the trial courts summary judgment on appellants defamation claim.
